Terms and conditions for user account at PlanetHomework.com

1. The present agreement
 
1.1 Purpose
 
The present agreement is a legal document that describes your and Student Media ApS‘s (”PlanetHomework, ”we” or ”us”) rights and obligations in connection with the services that Student Media ApS provides via PlanetHomework.com.
 
 1.2. The effect of the present agreement  
 
When you sign up for PlanetHomework’s services, you assent to the conditions in the present agreement, and you also confirm that you are informed about the terms of the agreement every time you use PlanetHomework’s services. Your marking in the box “I have read and accept the conditions” is viewed as constituting a legally binding agreement between you and PlanetHomework.
 
1.3 The length of the agreement 
 
The present agreement exists until it is replaced by a new version. Enactment takes place and is binding for all activities at PlanetHomework or via PlanetHomework’s services.
 
2. Registration
 
2.1 Registration of your user information
 
As a user at PlanetHomework you are obligated to create a user with your real name, email address, education, class, as well as other information you might be asked about. Remember that your email address is used for communication between you and PlanetHomework.
 
Your user account at PlanetHomework is strictly personal and must not be used by others. Your password is also personal and must not be handed on to others. Therefore your password is encoded at PlanetHomework, so, at all times, only you can have knowledge of it. This also means that it is not allowed to borrow, or in any other way gain access to other users’ accounts. 
 
Furthermore, it is not allowed to create more than one user account per person without prior agreement with PlanetHomework. Colleges and other educational facilities with special requests and needs can contact PlanetHomework via support.
 
2.2 Keeping up to date 
 
As a user at PlanetHomework, you are at all times responsible for keeping the information on your user profile up to date, meaning correct and valid.
 
2.3 Age
 
You must be 15 years or older in order to create a profile at PlanetHomework.
 
2.4 Closing your user account  
 
At any time and without any further notice, you can close your user account under the menu item My profile -> Edit profile.
 
PlanetHomework reserves the right to close your user account if you have acted against the present agreement, the rules and regulations of PlanetHomework or Danish law. If we choose to close your user account on one of these grounds, it is not possible to get any refunds of points or bought VIP-membership.
 
3. Personal data
 
3.1 Responsible for personal data 
 
Responsible for personal data is Student Media ApS, Sct. Leonis Gade 5, 8800 Viborg, CVR-number:  31 48 29 33. 
 
3.2 Servers 
 
All servers used to store your personal information are kept in secured premises.
 
3.3 Personal information 
 
PlanetHomework respects and safeguards your personal integrity. PlanetHomework therefore must inform you that we collect certain pieces of personal information about you when you visit www.PlanetHomework.com, and that the collection and treatment of such personal information is made with the below mentioned purposes.
 
In order to avoid fraud, we register our users’ IP-addresses. The IP-address can be used in connection with a possible police report as well.
 
3.4 Use of personal information 
 
We use your personal information in order to:
  • understand your needs better and improve our level of information as well as our products and services, e.g. regarding discounts and special offers;
  • carry out various surveys (e.g. scientific, social, as well as economical and marketing);
  • collect and store information used for reference or used for statistics;
  • inform you about our products and services in accordance to your specific request and preferences
PlanetHomework holds your personal information as long as it is necessary for PlanetHomework to keep its obligations to you, as well as its obligations according to existing danish law. 
 
3.5 Passing on information 
 
PlanetHomework will not pass on your information to third parties at any time, unless you in advance have given your personal consent.  Yet, PlanetHomework will pass on information if directed by law, or as an answer to a valid request from a court or public authority, as well as if a valid court order exists. 
 
3.6 Cookies 
 
In order to optimize PlanetHomework, we use cookies. Cookies are small pieces of information that are saved on your computer and sent to PlanetHomework every time you visit the website. Some of your prior made choices are saved here, making your experience of PlanetHomework more personal. You always have the option to delete your cookies via the settings in your internet browser, but this means that your settings will be lost.  
 
4. Advertising 
 
4.1 Newsletter
 
As a user you will receive PlanetHomework’s newsletter. Furthermore, PlanetHomework can use the email address you have given to send out messages about updates, information and more. Emails can at all times be unsubscribed from.
 
The newsletter may contain adverts for other companies.
 
PlanetHomework will not pass on your information to be used by other companies’ advert campaigns, see more under item 3.5, unless you have given your consent.
 
5. Responsibility and regular conditions
 
5.1 Immaterial rights
 
You recognize that all rights, trademarks and other immaterial rights connected with PlanetHomework’s services are owned by Student Media ApS.
 
5.2 Rights to downloaded papers and/or essays
 
Purchases as well as use of essays and papers from PlanetHomework entail a personal right to the use of the paper or essay, and the paper or essay may not be resold or distributed to other users without written consent from PlanetHomework. 
 
5.3 Access to re-download 
 
Purchased papers or essays are available for re-download via your personal folder for 12 months after your purchase.
 
5.4 Lack of access to PlanetHomework.com
 
PlanetHomework cannot guarantee that it is possible to gain access to PlanetHomework.com at all times, hence the website at times can be unavailable. This can be due to a planned temporary shut down or a technical breakdown, and in connection with something like this, PlanetHomework cannot be made responsible for any lack of access users might experience.
 
5.5 Damages 
 
PlanetHomework is not liable to you or a third party for indirect damages, damages by lack of access, loss of data, mark-ups, income or businesses, however it may have come about (whether it be because of negligence or default of present agreement or in some other way), even though such a loss or such a damage could have been foreseen by PlanetHomework, or if PlanetHomework had been made aware of the possibility that the eventuality was there.
 
5.6 Force majeure
 
PlanetHomework is not responsible for lack of uphold of our commitments according to the present agreement that are due to factors that PlanetHomework cannot control and which PlanetHomework with any reason could not have foreseen. 
 
6. PlanetHomework Points 
 
6.1 Purpose
 
PlanetHomework Points is the name of the virtual currency used on PlanetHomework. You can earn PlanetHomework Points by doing various activities on PlanetHomeWork.com, e.g. by adding essays or papers or rating your downloads. You can also buy PlanetHomework Points with real money by using the payment options that are available at PlanetHomework.com. PlanetHomework Points can be used to buy access to papers and essays, how to guides and other services from PlanetHomework.com. In order for you to use your PlanetHomework Points, you have to be logged in.
 
It is free to create and use your user account at PlanetHomework.
 
6.2 Maximum balance
 
You can maximally have a balance of 50,000 PlanetHomework points in your user account.
 
6.3 Inactivity fee
 
You will be charged with a smaller administration fee (currently 100 PlanetHomework points) if your user account has been inactive for 12 months. An active user profile is a user profile that has been logged in at PlanetHomework at least one time within the last 12 months. Hereafter, the administration fee will be charged from the account once a month if your user profile remains inactive. Of course, your balance cannot enter in deficit, meaning that the administration fee only will be charged as long as a deposit exists. As soon as there is activity in your user account again, the charging of the administration fee will stop. 
 
6.4 Exchanged to cash
 
Your PlanetHomework points cannot be exchanged to cash
